The Muslim Conduct of State I would like to reproduce here below paragraphs 330 to 335 from Dr. Muhammad Hamidullah's "The Muslim Conduct of State" in order to elaborate further on this subject. It should be borne in mind that this book is a recognized authority on Muslim International Law and that the law of Apostasy is discussed in the International context: article of the Canadian Society of Muslims ------------------------------------------------------------ Apostacy (Irtidad) in Islam 3. What After Submission? "What we have said above was about accepting Islam, coming into the fold of Islam. We have made it very clear that no one can be forcefully brought into the fold of Islam; Islam cannot be imposed on any person or society" "Once a person enters into the fold of Islam, the rules change. ...... And Islam clearly says: No! You cannot become an apostate. After coming into the fold of Islam, rejection of the fundamentals is not tolerated". "The punishment prescribed by the shari'a for apostacy is death. " www.al-islam.org |
Punishment of the one who leaves Islaam The punishment for apostasy (riddah) is well-known in Islaamic Sharee’ah. The one who leaves Islaam will be asked to repent by the Sharee’ah judge in an Islaamic country; if he does not repent and come back to the true religion, he will be killed as a kaafir and apostate, because of the command of the Prophet (peace and blessings of Allaah be upon him): "Whoever changes his religion, kill him." (Reported by al-Bukhaari, 3017). www.islam-qa.com: question 696 ------------------------------------------------------------ Why death is the punishment for Apostasy 1) This is the ruling of Allaah and His Messenger, as the Prophet (peace and blessings of Allaah be upon him) said: "Whoever changes his religion, kill him." (reported by al-Bukhaari, al-Fath, no. 3017). (2) The one who has known the religion which Allaah revealed, entered it and practised it, then rejected it, despised it and left it, is a person who does not deserve to live on the earth of Allaah and eat from the provision of Allaah. (3) By leaving Islaam, the apostate opens the way for everyone who wants to leave the faith, thus spreading apostasy and encouraging it. (4) The apostate is not to be killed without warning. Even though his crime is so great, he is given a last chance, a respite of three days in which to repent. If he repents, he will be left alone; if he does not repent, then he will be killed www.islam-qa: question 811 ------------------------------------------------------------ Hadith No.14 The committing of adultery, murder and apostasy are such heinous crimes that Islamic Law, which otherwise safegueards life, has deemed that those who commit such crimes no longer deserve life. article of the Strathclyde University Muslim Students Association |

Fatwa On Children ..... A child is ordered to pray when he reaches the age of seven, and beat them to do so at the age of ten, and it becomes obligatory upon him when he reaches puberty. ......... The source for the aforementioned is what Imaam Ahmad and Abu Daawood have related on the authority of the Prophet (sal-Allaahu `alayhe wa sallam): ((Order your children to pray at seven and beat them to pray at ten, and separate them from each other in bed)). The Permanent Committee for Academic Research and Fataawa, comprising: Head: Shaykh 'Abdul-'Azeez Ibn 'Abdullaah Ibn Baaz; Deputy Head: Shaykh 'Abdur-Razzaaq 'Afeefee; Member: Shaykh 'Abdullaah Ibn Ghudayyaan; Member: Shaykh 'Abdullaah Ibn Qu'ood Fataawa Ramadhaan - Volume 1, Page 233, Fatwa No.177; Fataawa al-Lajnah ad-Daa.imah lil-Buhooth al-'Ilmiyyah wal-Iftaa. - Fatwa No. 1787 article on website: "An-Nisa - for, by and about Muslim women" |
Raising Children Girls will not automatically put on hejab if they were never encouraged and taught to do so! Umm Amatullah has some hints on helping your daughter. The Prophet of Allah (s) said, "Command your children to pray when they become seven years old, and beat them for it (prayer) when they become ten years old; and arrange their beds (to sleep) separately." (Sunan of Abu-Dawood, Hadith 495, Narrated by Abdullah ibn Amr ibn al-'As). This hadeeth is to guide us in teaching our children to pray, that is, when they are seven years old you get them to pray so that when they reach the age of puberty (approximately at 10 years old) the prayer becomes an integral part of their life. article on website: "Muslimah's Services - UMM PUBLICATIONS" see also this google search |

Ibn Battuta: Travels in Asia and Africa 1325-1354 (Ibn Battuta judges the character of the people of Mali - lower part of the page: "Life at Walata") "Another of their good qualities is their habit of wearing clean white garments on Fridays. Even if a man has nothing but an old worn shirt, he washes it and cleans it, and wears it to the Friday service. Yet another is their zeal for learning the Koran by heart. They put their children in chains if they show any backwardness in memorizing it, and they are not set free until they have it by heart. I visited the qadi in his house on the day of the festival. His children were chained up, so I said to him, "Will you not let them loose?" He replied, "I shall not do so until they learn the Koran by heart." Ibn Battuta: Travels in Asia and Africa 1325-1354 |
Students freed from Kenyan 'torture' Tuesday, 28 January, 2003 .................. At the Kasarani police station, five kilometres from where they had been rescued, the children narrated their ordeal at the hands of islamic teachers bent on turning them into good Muslims. .................. "It was a terrible place, they chain both legs and both arms, sometimes hands and feet together," he said. "They beat you at lunch time, dinner time and grab both legs and hands and give you lashes on the buttocks." .................. "We sleep in chains, eat in chains, go to the toilets in chains. Sometimes we are hooked on the roof in chains and left hanging. We have to memorise the Koran and get punished if we cannot recite the Koran in the classroom". .................. news.bbc.co.uk |
Also, the early rejecters of Mohammed's 'invitation' to Islam seemed to have no other choice then to accept Islam or to be subdued or even killed by Allah's prophet of (islamic) Peace:
|
2. Waging War against Non-Muslims Authorities are of the opinion that Muslims must fight the polytheist nations as well as the Jews and Christians of today until they subdue them. It is further held that while the polytheist nations must be put to death if they do not accept faith, the Jews and Christians can be allowed to live on their religions if they submit to Muslim authority by paying Jizyah. The following verses are generally presented in support of this view: Slay the Idolaters wherever you find them. Seize them, surround them and everywhere lie in ambush for them. But if they repent from their wrong beliefs and establish regular prayers and pay Zakah, then spare their lives. God is Oft-Forgiving and Ever Merciful. (9:5) Fight those who believe not in Allah or the Last Day, nor hold that forbidden which has been forbidden by Allah and His Messenger, nor acknowledge the Religion of Truth, from among the People of the Book, until they pay the Jizyah after being subdued and live a life of submission. (9:29) |
It has been shown in the previous sections that these verses and other verses of similar meaning specifically pertain to the polytheists, the Jews and the Christians of the Prophet Muhammad’s times. They had deliberately denied the message of Muhammad (sws) and were as a result given this punishment. After Muhammad (sws), his authorized Companions (rta) carried on the mission against the major political powers of their times. This onslaught, it has been discussed earlier, was specific to their status as witnesses to the truth, and their endeavour was basically a manifestation of a divine scheme. Consequently, the age old debate about whether Islam was spread through the sword or not should also be understood in this perspective. The Companions (rta) of Muhammad (sws) in their collective capacity were only enforcing the implication of their status as witnesses to the religion of the truth. In reality, they were not spreading Islam; they were punishing people who had deliberately denied the truth. article in the Pakistani based Renaissance monthly magazine Renaissance's Mission statement: "Renaissance was launched in January 1991 with an aim to communicate the true message of Islam and to purge it from various innovations which have, over the years, crept into its edifice. The basic idea behind its initiation is to present the teachings of Islam in their pristine form and to apply its principles in current circumstances with a view to present positive solutions to the problems faced in the fields of law and politics, economics and sociology and indeed in all the other spheres of life." |
And a letter from Allah's prophet of Peace to the rulers of Oman, 'inviting' them to Islam or else:
8. A Letter to the King of Oman, Jaifer, and his Brother Abd Al-Jalandi:
"In the Name of Allah the Most Beneficent, the Most Merciful.
From Muhammad bin Abdullah to Jaifer and Abd Al-Jalandi.
Peace be upon him who follows true guidance; thereafter I invite both of you to the Call of Islam.
Embrace Islam. Allah has sent me as a Prophet to all His creatures in order that I may instil fear of Allah in the hearts of His disobedient creatures so that there may be left no excuse for those who deny Allah.
If you two accept Islam, you will remain in command of your country; but if you refuse my Call, you've got to remember that all your possessions are perishable.
My horsemen will appropriate your land, and my Prophethood will assume preponderance over your kingship."

Umar (Allah be pleased with them) reported Allah's Massenger (may peace be upon him) as saying: He who buys a tree after it has been fecundated, its fruit belongs to one who sells it except when the provision has been laid down by the buyer (that it will belong to him), and he who buys a slave, his property belongs to one who sells him except when a provision has been laid down by the buyer (that it will be transferred to him with the slave). |

Fatwa: masturbation is forbidden, but you can enjoy a slave girl in stead by Shaykh Muhammad Naasirud-Deen al-Albaanee Published: 28th May 2002 MISCELLANEOUS QUESTIONS AND THEIR RULINGS [56] Question: What is the ruling concerning masturbation? Answer: We have no doubts regarding the forbiddance of such a practice. And this is due to two reasons, the first of which is the saying of Allaah, the Most High, concerning the description of the believers: "Successful indeed are the believers. Those who offer their prayer with full submissiveness. And those who turn away from false and vain talk. And those who pay the Zakaah. And those who guard their chastity ; Except with their wives or (slaves) that their right hands possess, for (in that) they are free from blame. But whoever seeks beyond that, then those are the transgressors." [Surah Al-Mu’minoon: 1-8] Imaam Ash-Shaafi'ee used this ayah as proof for the forbiddance of masturbating. This is since, in this ayah, Allaah has placed two ways for the true Believers to fullfill their desires - either by marrying free women or by enjoying the slave women and female war captives. Then He says: "But whoever seeks beyond that, then those are the transgressors" meaning: Whosoever desires a way by which to transmit his desires, apart from these two ways of marriage and taking female war captives, then he is a transgressor and a wrongdoer. http://www.theclearpath.com |
Right Hand Possessions
Question: What is the meaning of right hand possession and what was the purpose of having them. Some brothers in America think it is okay to have right hand possessions now in the USA. Answer: Right hand possessions (Malak-ul-Yameen) means slaves and maids, those came in possession of Muslims through war or purchase. After having the possession of slave maid it is lawful and correct to have sexual relations with them. Even today if Muslims get possession over infidel country, this condition is possible, lawful and correct. www.binoria.org ------------------------------------------------------------ Ruling on having intercourse with a slave woman when one has a wife .... The scholars are unanimously agreed that it is permissible. .... The wife has no right to object to her husband owning female slaves or to his having intercourse with them. www.islam-qa.com: question 10382 |
|
Fatwa: Status of Slave Women in Islam by Islam Online Fatwa Committee - 19 November/ 2001 .... as it aimed at putting an end to such issue, Islam laid down rules which would eventually lead to eradicating the practice. So it allowed Muslims to have intercourse with slave women taken as captives of just and legitimate wars. In so doing, the woman would automatically become free if she got pregnant. What's more, her child would also become free. In the light of the above-mentioned facts, and the nature of the question posed by people, it's clear that some people misunderstand the wisdom behind the permissibility of having female slaves and think that it is meant to unleash men’s desires and give them more enjoyment. Never! That is not the point! It is, rather, means of freeing slaves; and this is clarified above in the fact that if a master got a female slave pregnant, then he could neither sell her nor give her away as a present. And if he died, she would not be considered part of his property. She'd receive her freedom and her baby would also be free. www.islamonline.net |
Sayings of the Prophet, NOT forbidding coitus interruptus with slave girls: Sahih Bukhari Volume 7, Book 62, Number 137 Narrated Abu Said Al-Khudri: We got female captives in the war booty and we used to do coitus interruptus with them. So we asked Allah's Apostle about it and he said, "Do you really do that?" repeating the question thrice, "There is no soul that is destined to exist but will come into existence, till the Day of Resurrection." Sunan Abu-Dawud, Book 11, Number 2166 Narrated AbuSa'id al-Khudri: A man said: Apostle of Allah, I have a slave-girl and I withdraw the penis from her (while having intercourse), and I dislike that she becomes pregnant. I intend (by intercourse) what the men intend by it. The Jews say that withdrawing the penis (azl) is burying the living girls on a small scale. He (the Prophet) said: The Jews told a lie. If Allah intends to create it, you cannot turn it away. |
Sahih Muslim Book 008, Number 3371:
Chapter 22: AL AZL (INCOMPLETE SEXUAL INTERCOURSE): COITUS INTERRUPTUS
Abu Sirma said to Abu Sa'id al Khadri (Allah he pleased with him): 0 Abu Sa'id, did you hear Allah's Messenger (may peace be upon him) mentioning al-'azl? He said: Yes, and added:
We went out with Allah's Messenger (may peace be upon him) on the expedition to the Bi'l-Mustaliq and took captive some excellent Arab women; and we desired them, for we were suffering from the absence of our wives, (but at the same time) we also desired ransom for them.
So we decided to have sexual intercourse with them but by observing 'azl (Withdrawing the male sexual organ before emission of semen to avoid-conception). But we said: We are doing an act whereas Allah's Messenger is amongst us; why not ask him? So we asked Allah's Mes- senger (may peace be upon him), and he said: It does not matter if you do not do it, for every soul that is to be born up to the Day of Resurrection will be born.

Sahih Bukhari, Volume 5, Book 59, Number 641:
Narrated Jarir: In the Pre-lslamic Period of Ignorance there was a house called Dhu-l-Khalasa or Al-Ka'ba Al-Yamaniya or Al-Ka'ba Ash-Shamiya. The Prophet said to me, "Won't you relieve me from Dhu-l-Khalasa?" So I set out with one-hundred-and-fifty riders, and we dismantled it and killed whoever was present there. Then I came to the Prophet and informed him, and he invoked good upon us and Al-Ahmas (tribe) . |

Allah's Apostle said to me, "Will you relieve me from Dhul-Khalasa?" So I left for it with 150 cavalrymen from the tribe of Ahmas and then we destroyed it and killed whoever we found there. Then we came to the Prophet and informed him about it. He invoked good upon us and upon the tribe of Ahmas. |

Sahih Bukhari, Volume 5, Book 59, Number 369:
Military Expeditions led by the Prophet (pbuh) (Al-Maghaazi)
Narrated Jabir bin 'Abdullah: Allah's Apostle said, "Who is willing to kill Ka'b bin Al-Ashraf [a poet] who has hurt Allah and His Apostle?" Thereupon Muhammad bin Maslama got up saying, "O Allah's Apostle! Would you like that I kill him?" The Prophet said, "Yes," Muhammad bin Maslama said, "Then allow me to say a (false) thing (i.e. to deceive Kab). " The Prophet said, "You may say it." Then Muhammad bin Maslama went to Kab and said, "That man (i.e. Muhammad demands Sadaqa (i.e. Zakat) from us, and he has troubled us, and I have come to borrow something from you." On that, Kab said, "By Allah, you will get tired of him!" Muhammad bin Maslama said, "Now as we have followed him, we do not want to leave him unless and until we see how his end is going to be. Now we want you to lend us a camel load or two of food." (Some difference between narrators about a camel load or two.) Kab said, "Yes, (I will lend you), but you should mortgage something to me." Muhammad bin Mas-lama and his companion said, "What do you want?" Ka'b replied, "Mortgage your women to me." They said, "How can we mortgage our women to you and you are the most handsome of the 'Arabs?" Ka'b said, "Then mortgage your sons to me." They said, "How can we mortgage our sons to you? Later they would be abused by the people's saying that so-and-so has been mortgaged for a camel load of food. That would cause us great disgrace, but we will mortgage our arms to you." Muhammad bin Maslama and his companion promised Kab that Muhammad would return to him. He came to Kab at night along with Kab's foster brother, Abu Na'ila. Kab invited them to come into his fort, and then he went down to them. His wife asked him, "Where are you going at this time?" Kab replied, "None but Muhammad bin Maslama and my (foster) brother Abu Na'ila have come." His wife said, "I hear a voice as if dropping blood is from him, Ka'b said. "They are none but my brother Muhammad bin Maslama and my foster brother Abu Naila. A generous man should respond to a call at night even if invited to be killed." Muhammad bin Maslama went with two men. (Some narrators mention the men as 'Abu bin Jabr. Al Harith bin Aus and Abbad bin Bishr). So Muhammad bin Maslama went in together with two men, and sail to them, "When Ka'b comes, I will touch his hair and smell it, and when you see that I have got hold of his head, strip him. I will let you smell his head." Kab bin Al-Ashraf came down to them wrapped in his clothes, and diffusing perfume. Muhammad bin Maslama said. " have never smelt a better scent than this. Ka'b replied. "I have got the best 'Arab women who know how to use the high class of perfume." Muhammad bin Maslama requested Ka'b "Will you allow me to smell your head?" Ka'b said, "Yes." Muhammad smelt it and made his companions smell it as well. Then he requested Ka'b again, "Will you let me (smell your head)?" Ka'b said, "Yes." When Muhammad got a strong hold of him, he said (to his companions), "Get at him!" So they killed him and went to the Prophet and informed him. (Abu Rafi) was killed after Ka'b bin Al-Ashraf." |
Sunan Abu-Dawud Book 38, Number 4348: (scroll to no.4348) Narrated Abdullah Ibn Abbas: A blind man had a slave-mother who used to abuse the Prophet (peace_be_upon_him) and disparage him. He forbade her but she did not stop. He rebuked her but she did not give up her habit. One night she began to slander the Prophet (peace_be_upon_him) and abuse him. So he took a dagger, placed it on her belly, pressed it, and killed her. A child who came between her legs was smeared with the blood that was there. When the morning came, the Prophet (peace_be_upon_him) was informed about it. He assembled the people and said: I adjure by Allah the man who has done this action and I adjure him by my right to him that he should stand up. Jumping over the necks of the people and trembling the man stood up. He sat before the Prophet (peace_be_upon_him) and said: Apostle of Allah! I am her master; she used to abuse you and disparage you. I forbade her, but she did not stop, and I rebuked her, but she did not abandon her habit. I have two sons like pearls from her, and she was my companion. Last night she began to abuse and disparage you. So I took a dagger, put it on her belly and pressed it till I killed her. Thereupon the Prophet (peace_be_upon_him) said: Oh be witness, no retaliation is payable for her blood. "no retaliation is payable for her blood" = you won't get punished for killing her ------------------------------------------------------------ Sahih Muslim Book 004, Number 2127: Muhammad b. Qais said (to the people): Should I not narrate to you (a hadith of the Holy Prophet) on my authority and on the authority of my mother? We thought that he meant the mother who had given him birth. He (Muhammad b. Qais) then reported that it was 'A'isha who had narrated this: Should I not narrate to you about myself and about the Messenger of Allah (may peace be upon him)? We said: Yes. She said: When it was my turn for Allah's Messenger (may peace be upon him) to spend the night with me, he turned his side, put on his mantle and took off his shoes and placed them near his feet, and spread the corner of his shawl on his bed and then lay down till he thought that I had gone to sleep. He took hold of his mantle slowly and put on the shoes slowly, and opened the door and went out and then closed it lightly. I covered my head, put on my veil and tightened my waist wrapper, and then went out following his steps till he reached Baqi'. He stood there and he stood for a long time. He then lifted his hands three times, and then returned and I also returned. He hastened his steps and I also hastened my steps. He ran and I too ran. He came (to the house) and I also came (to the house). I, however, preceded him and I entered (the house), and as I lay down in the bed, he (the Holy Prophet) entered the (house), and said: Why is it, O 'A'isha, that you are out of breath? I said: There is nothing. He said: Tell me or the Subtle and the Aware would inform me. I said: Messenger of Allah, may my father and mother be ransom for you, and then I told him (the whole story). He said: Was it the darkness (of your shadow) that I saw in front of me? I said: Yes. He struck me on the chest which caused me pain , and then said: Did you think that Allah and His Apostle would deal unjustly with you? ... |

Maimuna reported that one morning Allah's Messenger (may peace be upon him) was silent with grief. Maimuna said: Allah's Messenger, I find a change in your mood today. Allah's Messenger (may peace be upon him) said: Gabriel had promised me that he would meet me tonight, but he did not meet me. By Allah, he never broke his promises, and Allah's Messenger (may peace be upon him) spent the day in this sad (mood).
Then it occurred to him that there had been a puppy under their cot. He commanded and it was turned out. He then took some water in his hand and sprinkled it at that place. When it was evening Gabriel met him and he said to him: you promised me that you would meet me the previous night. He said: Yes, but we do not enter a house in which there is a dog or a picture.
Then on that very morning he commanded the killing of the dogs until he announced that the dog kept for the orchards should also be killed, but he spared the dog meant for the protection of extensive fields (or big gardens).

There is a sahih hadith from Muslim that tells us how the black stone used to pay salutations to Mohammed in the pre-islamic, pagan era when Mohammed himself was still a pagan non-muslim. (interesting fatwa) Sahih Muslim, Book 030, Number 5654: Jabir b. Samura reported Allah's Messenger (may peace be upon him) as saying: I recognise the stone in Mecca which used to pay me salutations before my advent as a Prophet and I recognise that even now. We may assume that this was the reason Mohammed made kissing the black stone part of one of the pillars of faith - the islamic pilgrimage - the Hajj. It was in the pre-islamic 'era of ignorance' that Mohammed grew up. It was the period when the black stone was still the subject of various pagan rites in honour of female godesses like Allat, Manat and Uzza, and when stone-kissing and stone-worshipping in general was not uncommon among the arab tribes . |
After Mohammed declared himself a prophet he maintained the pagan rite of kissing the black stone, and incorporated it into the islamic rituals, even to the amazement of some of his followers: Sahih Bukhari Volume 2, Book 26, Number 679: Narrated Zaid bin Aslam that his father said: "I saw 'Umar bin Al-Khattab kissing the Black Stone and he then said, (to it) 'Had I not seen Allah's Apostle kissing you, (stone) I would not have kissed you.' " Sahih Bukhari Volume 2, Book 26, Number 667: Narrated 'Abis bin Rabia: 'Umar came near the Black Stone and kissed it and said "No doubt, I know that you are a stone and can neither benefit anyone nor harm anyone. Had I not seen Allah's Apostle kissing you I would not have kissed you." (note how they talk to the stone as if it can hear and understand them) see: highlighted Bukhari hadiths (scroll down, starting at number 667) |
Istlam (Kissing the Hajr-e-Aswad)www.islam.com
The act of kissing the Hajr-e-Aswad (Black Stone) is called Istlam. While kissing the Hajr-e-Aswad, ones hands should be on the wall of the Ka'ba in the same position as when one performs a Sajdah (prostration) during a prayer. If it is not possible to kiss the Hajr-e-Aswad, it is permissible just touch it with a hand and if that is not possible then just point to the Hajr-e-Aswad and blow a kiss to it.
Tawaaf.
After performing Istlam (kissing the Hajr-e-Aswad) as described above, a pilgrim should perform Tawaaf of Ka'ba. Tawaaf is performed by going around Ka'ba seven times keeping the Ka'ba on left hand side (counter clock-wise). Istlam should be performed during each circle. It is also permitted to perform Istlam of Rukun-e-Yemeni (Pillar of Yemen). The seventh circle ends at the Hajr-e-Aswad.
Returne to kabba.
On the 12th or the 13th day of Dul-Hajj, the pilgrim returns to the Ka'ba and perform a final circuit. This circuit is called Tawaf-al-Sadr or Tawaf-al-Wida (parting or farewell circuit). After this last circuit, the pilgrim should drink water from Zumzum, kiss the threshold of the door of the Ka'ba , and pray to Allah for forgiveness. He should leave the Ka'ba walking backwards, looking at it the last time, and saying farewell.
